1. Description of Promotion

Welcome to the Path to NAPT promotion (the “Promotion”), where all participants are eligible to earn a $.50 Path to NAPT Spin and Go ticket, as indicated in their communications from the sponsor, upon satisfying the Promotion Requirements (as defined below).

The Promotion is sponsored by TSG Interactive US Services Limited (“TSG” or the “Sponsor”).  The terms “you” or “your” mean the person to whom a Promotion Bonus (as defined below) is issued to upon satisfaction of the terms and conditions set forth in this Promotion.  Redemption of the Promotion is expressly conditioned upon acceptance of and compliance with all of these Promotion “Terms and Conditions”.  Promotion participants may be required to sign paperwork issued by the Sponsor.

2. Promotion Period

The Promotion takes place will take place between 6:00 AM ET June 10, 2024 and 23:59 ET October 21, 2024 (the “Promotion Period”).

3. Eligibility

The Promotion is only open to individuals who are at least 21 years of age, physically present in Pennsylvania, New Jersey, and Michigan during the Promotion Period and have received an invitation from Sponsor. Invitation is non-transferable and if you were not directly invited by Sponsor, you may not participate in this Promotion. If your social security number is associated with another TSG Account in Sponsor's database, you may only earn one Promotion Bonus in respect of all such TSG Accounts under this Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Promotion Bonus. 

4. Action Required

Account holders must log in to their TSG Account and will then receive their tickets (the “Promotion Requirements”).

5. Claiming Promotion Offer

Upon satisfying the Promotion Requirements, you will win a $.50 Path to NAPT Spin and Go ticket upon meeting the required challenge requirements (the “Promotion Bonus”). If applicable, the Promotion Bonus will be credited to your TSG Account within seventy-two (72) hours of your satisfaction of the Promotion Requirements. Promotion Bonus recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Bonus received, regardless of whether the Promotion Bonus, in whole or in part, is used. The Promotion Bonus value may be reported for tax purposes as required by law.

7. Limitations on Participation

In addition to the eligibility requirements in Section 3, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any Promotion for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. This Promotion is void where prohibited by law.  Limit of one (1) Promotion Bonus per person during the Promotion Period.

9. Order of Funds Used for Wagering

Players must have eligible funds in their PokerStars wallet in order to participate in the challenge.

11. Restrictions on Withdrawal

The Promotion Bonus is not withdrawable or transferable and cannot be substituted except in the Sponsor’s sole discretion. The Promotion Bonus is non-withdrawable, but any winnings therefrom (less the stake) are immediately withdrawable.  The Promotion Bonus may only be used for wagering on your TSG Account. The Promotion Bonus will be automatically withdrawn from your TSG Account at the end of the Promotion Period.

12. Cancellation

Should you wish to cancel your participation in the Promotion at any time, please contact customer support at support@starssupportnj.com (for New Jersey participants), support@starssupportpa.com (for Pennsylvania participants) or support@starssupportmi.com (for Michigan participants). Upon cancellation, you may withdraw any funds you have deposited into your PokerStars Account without restriction. However, any Promotion Bonus amount in your PokerStars Account may not be withdrawn.

14. Additional Terms

Administration:  The Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent.  Administration of this Promotion is at the sole discretion of the Sponsor.  Sponsor reserves the right to restrict at any time any TSG Account holder from participating in this Promotion for any reason.  Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability:  By redeeming this Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence.  The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Bonus.  In consideration of the Promotion Bonus, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution:  The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.  The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in New York, New York.  The federal or state law that applies to these Terms and Conditions will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York.  The Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing).  Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Miscellaneous:  No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.

Welcome to the NAPT Gold Pass promotion (the “Promotion”) where players can win an NAPT Gold Pass for NAPT Las Vegas Main Event to be played November 5-10, 2024.

The Promotion is sponsored by TSG Interactive US Services Limited (the “Sponsor”). In these Official Rules, a reference to “you” or “your” or “participant” is a reference to persons wishing to participate in the Promotion. Participation in the Promotion is expressly conditioned upon acceptance of, and compliance with all requirements set out in, these Official Rules. You may be required to sign paperwork issued by the Sponsor.

3. Eligibility

To enter the Promotion, you must be at least 21 years of age, have a PokerStars Account (as defined in Section 6 below), be physically present in New Jersey, Pennsylvania or Michigan when you participate in the Promotion (depending on whether you are playing on the www.pokerstarsnj.com, pokerstarsmtairycasino.com or www.pokerstarsmi.com website respectively) and have received an invitation from Sponsor. The invitation is non-transferable and if you were not directly invited by the Sponsor, you will not be eligible to participate in the Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or win a NAPT Gold Pass. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, the Sponsor and/or one or more of its affiliates and/or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions which the Sponsor and/or its affiliates and/or gaming license partners operate are not eligible to participate in the Promotion or win the NAPT Gold Pass.

4. Action Required

To participate in the Promotion, you must do the following:

Play in an eligible event on PokerStars or PokerStars LIVE that awards a Gold Pass, package valued at $10,000.

By participating in the Promotion, you agree that you have reviewed and accept these Official Rules and the Sponsor’s Privacy Policy and Terms of Service (as set out in Section 6 below). You agree to abide by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.

5. Claiming Promotion Offer

Upon winning a Tournament, you will be entitled to receive the NAPT Gold Pass (subject to the provisions of these Official Rules).

The Sponsor will contact the NAPT Gold Pass winners by email (using the address linked to their PokerStars Account) within 72 hours of the Tournament’s completion. The winners must claim their NAPT Gold Pass by responding to the Sponsor’s email by no later than October 21, 2024. If a winner does not claim their NAPT Gold Pass by October 21, 2024, their NAPT Gold Pass may be forfeited and declared void at the Sponsor’s discretion, and their NAPT Gold Pass may be offered to another participant in the order of finishing in the applicable Tournament.

The NAPT Gold Pass consists of the following for the winner and one companion:

- US$5,300 buy-in for the winner to NAPT Las Vegas Main Event (November 5-10, 2024);

- $1,800 in travel cash.

- $2,900 for hotel expenditures.

The total approximate retail value (“ARV”) of the NAPT Gold Pass is US$10,000.

NAPT Gold Pass T&Cs: 1. The winners’ companions must be aged 21 or over. 2. Flights can only be arranged from the winners’ state of residence. 3. The NAPT Gold Pass does not include any costs, taxes, fees, expenses and/or arrangements not expressly specified in the NAPT Gold Pass description. The winners and their companions are solely responsible for, and the Sponsor will not be liable to reimburse the winners/their companions for, any such additional charges and expenses. 4. The $1,800 expenses allowance (“Allowance”) is intended to be used for flights and expenses associated with the trip to Las Vegas. The Allowance will be credited to the winners’ PokerStars Accounts following acceptance of the NAPT Gold Pass in accordance with this section. If the Allowance is credited to a winner’s PokerStars Account and that winner is subsequently unable to attend the Events, that winner must notify PokerStars as soon as possible ahead of the intended travel date and must return the full amount of the Allowance to PokerStars within 7 days. 5. The winners and their companions must coordinate all travel arrangements through PokerStars Travel and use the carriers and providers selected by PokerStars Travel or its designated agent. The winners and their companions must travel together and must follow the itinerary provided by PokerStars Travel or its designated agent. The winners will be free to select flights and transfers of their choice for themselves and their companion, on dates of their choice, in liaison with PokerStars Travel provided that they attend the Events. If the total cost of the selected flights and transfers exceeds the Allowance, and this is permitted by PokerStars Travel (in its discretion), the winners will be liable to pay the amount exceeding the Allowance on the payment terms stipulated by PokerStars Travel. 6. It is the responsibility of the winners and their companions to check any requirements for the airline, hotel, Event venues and any other supplier providing elements of the NAPT Gold Pass. The winners and their companions are bound by, and must comply with, any terms and conditions set out on their Event and airline tickets and the rules, regulations, requirements and policies of the airline, hotel, Event venues, Event promoters and any other supplier connected with the NAPT Gold Pass. The Sponsor is not responsible for any failure of the winners and/or their companions to gain entry or re-entry to the airline, hotel and/or Events, or to participate in any element of the NAPT Gold Pass, due to any action/inaction on the part of the winners and/or their companions. 7. It is the responsibility of the winners and their companions to check and ensure that they satisfy all customs, security and immigration requirements in relation to travel between Las Vegas and their state of departure (including all requirements relating passports, visas and other documentation). The Sponsor has no liability if the winners and/or their companions are refused entry because they do not satisfy such requirements and the winners/their companions are solely responsible for all costs associated with refused entry. 8. It is the responsibility of the winners and their companions to check any government travel advisories relating to the travel destination and to determine what action to take in relation to any such advisories. The Sponsor has no liability if the winners/their companions do not make such checks, if they choose to travel despite the advice given in any relevant advisory or if they choose not to travel on the advice given in any relevant advisory (in which case the Sponsor will not be obliged to offer a substitute award). 9. It is the responsibility of the winners and their companions to check whether any vaccinations and/or prescription medicines are recommended or required prior to travel and the Sponsor has no liability in this respect. 10. It is the responsibility of the winners and their companions to take out their own travel insurance in connection with the NAPT Gold Pass. The Sponsor will have no liability for any failure by the winners and/or their companions to take out travel insurance and/or to comply with the terms and conditions of their travel insurance policy. 11. The Sponsor has no liability for lost or stolen tickets, vouchers, certificates and/or other documentation connected with the NAPT Gold Pass. 12. All elements of the NAPT Gold Pass are strictly non-transferable, non-exchangeable and may not be re-sold. No cash or any other alternative is available for any element of the NAPT Gold Pass. No alternative dates are available. 13. If a winner is unable to use/take part in any element of the NAPT Gold Pass, for any reason beyond the Sponsor’s reasonable control, the Sponsor is not obliged to offer an alternative award or any cash alternative or compensation. If a winner is unable to go on the trip to Las Vegas or attend any of the Events, they must inform the Sponsor as soon as possible and their entire NAPT Gold Pass will be forfeited, following which the Sponsor may, in its discretion, offer their NAPT Gold Pass to another participant in the order of finishing in the applicable Tournament until an alternate winner who is able to attend is found. 14. The winners and their companions must not do anything that may bring the Sponsor, any of its group companies or its commercial partners into disrepute. The Sponsor reserves the right to take appropriate action (including the removal of any element of the NAPT Gold Pass) if the winners and/or their companions act in a way that the Sponsor reasonably considers to bring the Sponsor, any of its group companies or its commercial partners into disrepute. 15. The Sponsor is not liable for any loss, theft, damage or injury caused or sustained by the winners/their companions as a result of participating in the NAPT Gold Pass (except that the Sponsor will be liable for death or personal injury arising from the Sponsor’s negligence or for fraudulent misrepresentation). 16. NAPT Gold Pass details and availability are subject to change and the NAPT Gold Pass providers’ rules and restrictions, and in the event that the Sponsor is unable to provide a winner with their NAPT Gold Pass, the Sponsor may elect to provide them with cash equivalent to the ARV of the NAPT Gold Pass or an alternate award of comparable or greater value. 16. The NAPT Gold Pass is awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). 17. The ARV of the NAPT Gold Pass is based on available information provided to the Sponsor. The Sponsor is not responsible for, and the winners will not receive, the difference, if any, between the actual value of the NAPT Gold Pass at the time of award and the ARV stated in these Official Rules or in any promotion-related correspondence or material.  18. The winners may be required to provide the Sponsor with a valid social security number before their NAPT Gold Pass is awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of the winners.

PokerStars will award up to 100 Gold Passes during the duration of the promotion. PokerStars reserves the right to discontinue the awarding of Gold Passes at any time during the promotional period.

Players who have already won a single Gold Pass may not be eligible to win a second Gold Pass. Any player who qualifies to win a second Gold Pass will instead receive $5,300 in tournament dollars to use on PokerStars.

Participants will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the NAPT Gold Pass, regardless of whether the NAPT Gold Pass is used. The NAPT Gold Pass value may be reported for tax purposes as required by law.

Tampering with Promotion:  The Sponsor is not responsible for the actions of participants in connection with the Promotion, including participants’ attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Promotion.  Persons found tampering with or abusing any aspect of the Promotion, or whom the Sponsor believes to be causing malfunction, error, disruption or damage may be disqualified.  Additionally, any attempt to cheat the Promotion, as determined at the sole and absolute discretion of the Sponsor, may result in immediate disqualification of the relevant participant, as well as other possible consequences, including disqualification from any and all existing and future Sponsor promotions.  ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING ANY SOCIAL MEDIA PLATFORM OR APPLICATION) OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  The Sponsor reserves the right, at its sole and absolute discretion, to disqualify (or terminate the award to) any participant who is found to be, or suspected of, acting in violation of these Official Rules, or to be acting in an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.

Suspension / Modification / Termination:  In the event the Sponsor is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control, the Sponsor shall have the right to modify, suspend or terminate the Promotion. The Sponsor additionally reserves the right, in its sole and absolute discretion: (a) to modify, suspend or terminate the Promotion should causes beyond the Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (b) to disqualify any participant found to be, or suspected of: (i) tampering with the entry process or the operation of the Promotion; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner.

Release and Waiver of Liability:  By participating in the Promotion, you agree to release, discharge, indemnify and hold harmless the Sponsor and its directors, officers, employees, agents, successors and assigns (collectively, “Released Parties”) from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines or injuries (up to and including bodily injury and death) of any kind arising out of or related to: (i) your participation in the Promotion (including travel associated with the NAPT Gold Pass); (ii) any acceptance, possession, misuse or use of the NAPT Gold Pass (including, without limitation, losses, damages or injuries to your or any other person’s equipment or other property, or to your/their persons, including those arising from any travel associated with the NAPT Gold Pass); (iii) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (iv) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Promotion activity and/or NAPT Gold Pass.  Without limiting the generality of the foregoing, you agree that the Released Parties have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Promotion and/or with respect to the NAPT Gold Pass, including, without limitation, to the NAPT Gold Pass’s quality or fitness for a particular purpose. You agree and that the Released Parties shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by the Sponsor interruption or inability to access the website, application or any online service via the Internet due to hardware or software compatibility problems; any damage to your (or any third person’s) computer and/or its contents related to or resulting from any part of the Promotion; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or malfunctions, even if caused by the negligence of the Released Parties. You further agree to indemnify and hold harmless the Released Parties from and against any and all liability resulting or arising from the Promotion and to release all rights to bring any claim, action or proceeding against the Released Parties and hereby acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the NAPT Gold Pass, including express warranties provided exclusively by a supplier that may be sent along with the NAPT Gold Pass. The Released Parties are not responsible for any changes or unavailability of the social media platform used for purposes of administering the Promotion that may interfere with the Promotion (including any limitations, any restrictions, or any conditions on the Sponsor’s ability to use the social media platform for the Promotion as set forth herein that are not acceptable to the Sponsor) or your ability to timely enter, receive notices or communicate with the Sponsor via the social media platform, in which case the Sponsor, in its sole discretion, may terminate or modify the Promotion.

Entry Information and Promotion Communications:  As a condition of entering the Promotion, you give consent for the Sponsor to obtain and deliver your name, address and other information to third parties for the purpose of administering the Promotion and to comply with applicable laws, regulations and rules.  Any information you provide to the Sponsor may be used to communicate with you in relation to the Promotion and may be used on the Promotion winners’ list.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants, the Sponsor and/or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

BY ENTERING THE PROMOTION, YOU AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED US$10.00, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED US$10.00, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

Miscellaneous:  The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Sponsor’s failure to enforce any provision of these Official Rules will not constitute a waiver of that provision. You agree to waive any rights to claim ambiguity of these Official Rules.  Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of any provision hereof.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, Privacy Policy or Terms of Service on any website, social media platform or application and/or these Official Rules, these Official Rules shall prevail, govern and control and the discrepancy will be resolved in the Sponsor’s sole and absolute discretion.
